{"id":6571,"date":"2020-04-06T11:14:29","date_gmt":"2020-04-06T15:14:29","guid":{"rendered":"https:\/\/beta.homelessvoice.org\/?p=6571"},"modified":"2020-06-22T17:45:12","modified_gmt":"2020-06-22T17:45:12","slug":"homeless-criminalization-continues","status":"publish","type":"post","link":"https:\/\/beta.homelessvoice.org\/?p=6571","title":{"rendered":"Homeless Criminalization Continues"},"content":{"rendered":"<h2>A law firm\u2019s report shows how city\u2019s ordinances criminalize basic human behavior<\/h2>\n<h6><em>By Andrew Fraieli<\/em><\/h6>\n<p><span style=\"font-weight: 400;\">Sacramento, California filed a lawsuit to ban certain homeless individuals from public spaces \u2014 having declared them public nuisances; Kansas City, Missouri\u2019s health department <\/span><a href=\"https:\/\/nypost.com\/2018\/11\/12\/health-department-poured-bleach-on-food-meant-for-the-homeless\/\"><span style=\"font-weight: 400;\">poured bleach on a food pantry\u2019s food<\/span><\/a><span style=\"font-weight: 400;\"> to deter the eating of it, as they considered the food a safety hazard \u2014 the homeless still ate it; and Ocala, Florida has made it illegal to \u201crest while awake or asleep\u201d on public property in the open.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">According to a report titled <\/span><a href=\"http:\/\/nlchp.org\/wp-content\/uploads\/2019\/12\/HOUSING-NOT-HANDCUFFS-2019-FINAL.pdf\"><span style=\"font-weight: 400;\">\u201cHousing not Handcuffs\u201d<\/span><\/a><span style=\"font-weight: 400;\"> released by the National Law Center on Homelessness and Poverty, these are only a few \u2014 but some of the most extreme \u2014 laws criminalizing homelessness across the country. By making laws that specifically target the homeless themselves, they aren\u2019t able to live without breaking one; cities have made the homeless criminals with little ability to defend.<\/span><\/p>\n<blockquote>\n<h5>&#8220;They state that police would wake people from sleep to tell them that sleeping outside in Durango city was illegal.&#8221;<\/h5>\n<\/blockquote>\n<p><span style=\"font-weight: 400;\">Some laws have banned sleeping in a car overnight, such as a recently reenacted <\/span><a href=\"http:\/\/clkrep.lacity.org\/onlinedocs\/2014\/14-1057-S8_ord_draft_07-22-2019.pdf\"><span style=\"font-weight: 400;\">ordinance in Los Angeles<\/span><\/a><span style=\"font-weight: 400;\">. Other laws make sitting on the sidewalk illegal, most notably in San Francisco in 2010 but recently, in 2018, <\/span><a href=\"http:\/\/cdn.ca9.uscourts.gov\/datastore\/opinions\/2018\/09\/04\/15-35845.pdf\"><span style=\"font-weight: 400;\">deemed unconstitutional<\/span><\/a><span style=\"font-weight: 400;\"> by the Ninth U.S. Circuit Court of Appeals. There are many different laws that can have an end result of criminalizing some aspect or behavior of a homeless person\u2019s life, and, like these, they are commonly built around a necessary action like sleeping or using the restroom.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">One of the highlights from the \u201cHousing not Handcuffs\u201d report was that 72% of the 187 cities the law center looked at had \u201cat least one law restricting camping in public.\u201d Camping in public can also mean different things depending on the city, with some laws being more or less broad to the point that their enforcement can\u2019t be predicted.<\/span><br \/>\n<span style=\"font-weight: 400;\">Eurgen, Oregon for example, <\/span><a href=\"https:\/\/www.eugene-or.gov\/ArchiveCenter\/ViewFile\/Item\/4335\"><span style=\"font-weight: 400;\">prohibits sleeping in a campsite<\/span><\/a><span style=\"font-weight: 400;\"> that it defines in part as \u201cany place where any bedding, sleeping bag, or other material used for bedding purposes\u2026\u201d is maintained. It functionally bans using anything to protect oneself from the elements, even as simple as a blanket. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Some laws that are not written as bans on sleeping can still end up being enforced as one.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The law center and ACLU of Colorado released a report in 2018 called <\/span><a href=\"https:\/\/acluco-wpengine.netdna-ssl.com\/wp-content\/uploads\/2018\/12\/A-YEAR-WITHOUT-SLEEP-web.pdf\"><span style=\"font-weight: 400;\">\u201cA Year Without Sleep\u201d<\/span><\/a><span style=\"font-weight: 400;\">, analyzing police reports in Durango, Colorado where they found that \u201cDurango police have stretched the City\u2019s ban on \u2018camping\u2019 to target a harmless behavior that homeless residents cannot avoid: sleep.\u201d It continues that in one year, only three citations were giving to people sleeping under tarps, but \u201c45 citations (46% of total) were issued to people who were sleeping under a blanket or in a sleeping bag, and 32 citations (33% of total) were issued to people sleeping on the ground without any cover whatsoever.\u201d <\/span><span style=\"font-weight: 400;\">They state that police would wake people from sleep to tell them that sleeping outside in Durango city was illegal.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Sleeping is a dominant issue in the report, pointing towards the dominance of outlawing sleeping or activities that may lead to sleeping in many cities. Ocala, Florida is mentioned directly in the report in what it calls it\u2019s \u201cHall of Shame.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">It states that \u201chomeless people are strictly policed in accordance with Ocala\u2019s draconian anti-homeless ordinances\u201d where it\u2019s \u201cillegal to rest in the open on public property, which has been heavily enforced by the city.\u201d They go on to describe the mayor\u2019s <\/span><a href=\"https:\/\/www.ocalafl.org\/Home\/Components\/News\/News\/9072\/\"><span style=\"font-weight: 400;\">self-promotion<\/span><\/a><span style=\"font-weight: 400;\"> of his \u201cbroken-windows\u201d policing sentiment which is a \u201cdiscredited policing model which asserts that open signs of disorder such as broken windows invite further crimes when left unaddressed.\u201d<\/span><\/p>\n<blockquote>\n<h5>&#8220;Comparing them to Jim Crow laws, the report deems them discriminatory as they give such broad power to the police,&#8221;<\/h5>\n<\/blockquote>\n<p><span style=\"font-weight: 400;\">The report\u2019s main issue with the policing tendencies of Ocala besides it\u2019s laws limiting the ability of people without a home to rest, is it\u2019s \u201ccity-sponsored police patrol that has made over 200 \u201cquality-of-life\u201d arrests between December 3, 2018 and April 1, 2019,\u201d of which three people alone have racked up $9,000 in fines, fees and cost and spent a total 210 days in jail based on this ordinance alone.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Other laws that can be broadly used to remove the homeless from public areas are loitering and vagrancy laws. Comparing them to Jim Crow laws, the report deems them discriminatory as they give such broad power to the police, with 35% of cities having laws prohibiting it, and 60% with laws prohibiting in certain public spaces.<\/span><br \/>\n<span style=\"font-weight: 400;\">These laws are specific examples of criminalizing the homeless when they have no choice. They have nowhere else to go except this public space, and then are arrested for it.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">People across the country have created their own ways of helping the homeless and people in need on the streets, there are many food pantries \u2014 such as the <\/span><a href=\"https:\/\/beta.homelessvoice.org\/the-furniture-store-that-feeds-the-homeless\/\"><span style=\"font-weight: 400;\">Rose K. Boatwright<\/span><\/a><span style=\"font-weight: 400;\"> Food Pantry in Lake City, Florida \u2014 many examples of ways to help the homeless shower such as the Shower to the People in St. Louis, Missouri, and even Triangle Works in Denver, Colorado \u2014 a five person crew that cleans garbage near parks where homeless people congregate so to help their areas stay clean.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The report makes an effort to highlight all these issues and how laws can be changed to help, instead of hurt.
